The State of Interdiction: the Inability to Govern oneself
Abstract
Throughout history, the treatment of mental illness, like any other type of human disability, has been marked by violence, social exclusion, and the dehumanization of people who have been labeled abnormal. The legal field is no exception. The interest of this work is to present the validity of the legal institution of the state of interdiction, México mostly, not only as the permanence of an obstacle in the exercise of the fundamental rights of the people declared in interdict, but as the vestige of ideas and prejudices that formed a legal institution whose origins date back to Roman law and which reflects the position of anachronistic and discriminatory models of disability treatment.Downloads
